Hi and welcome to reallygoodwills.com, a site owned and operated by Wightman Legal, LLC.

The Terms and Conditions of Use ("Agreement") is a legal agreement between you (“User”) and Wightman Legal, LLC (hereinafter referred to as "Website Owner"), the owner and developer of reallygoodwills.com (“Site”). BY USING SITE YOU AGREE TO BE BOUND BY THE TERMS SET FORTH IN THIS AGREEMENT (the "Terms"). Please read the Terms carefully before using the website.  The Terms are subject to change at any time, and the new terms will be posted on our website.

YOU AGREE THAT BY USING THE SITE AND THE SERVICES YOU ARE AT LEAST 18 YEARS OF AGE, YOU ARE LEGALLY ABLE TO ENTER INTO A CONTRACT AND AGREE TO COMPLY WITH ALL APPLICABLE LAWS AND REGULATIONS.WEBSITE OWNER RESERVES THE RIGHT TO CHANGE THE TERMS AT ANY TIME AND WITHOUT NOTICE TO YOU.
  1. Limitations of Liability and Indemnification. By using Site, you agree that in no event will Site, Website Owner, its and their officers, employees, agents, affiliates, licensees and web hosting services be liable for any direct or indirect, incidental, special or consequential damages as a result of your accessing the website and using any of the services available. Your sole remedy for any breach or default of this Agreement by Site or Website Owner shall be a return of any fees paid to the Website Owner in the last twelve months or $100 whichever is greater. You indemnify and agree to defend and hold harmless Site, Website Owner, its and their officers, employees, agents, affiliates, licensees and web hosting services and third parties for any losses, costs, liabilities and expenses (including but not limited to court costs, legal fees, awards or settlements) relating to or arising out of your use of Site, including any breach by you of the Terms contained in this Agreement.
  2. Responsibility for Use of Website. You understand and agree that you are solely responsible for your actions on Site. Website Owner takes reasonable precautions to host website on a reliable and safe hosting platform and to maintain the site. However, Website Owner takes no responsibility nor do we make any explicit representations or warranties as to Site safety or your individual use of the website. Additionally, the terms and conditions are subject to change at any time.
  3. Privacy Policy. Site respects your privacy and permits you to control the treatment of your personal information.     In connection with the use of certain reallygoodwills.com products or Services, you may be asked to provide personal information in a questionnaire, application, form or similar document or service. This information will be protected pursuant to our Privacy Policy. In addition, you grant reallygoodwills.com a worldwide, royalty-free, nonexclusive, and fully sublicensable license to use, distribute, reproduce, modify, publish and translate this personal information solely for the purpose of enabling your use of the applicable service. You may revoke this license and terminate reallygoodwills.com’s rights at any time by contacting support@wightmanlegal.com to remove your personal information from the applicable service.
  4. Do Not Rely on Site. Opinions, advice, statements or other comments should not necessarily be relied upon and are not to be construed as professional advice from Site or Website Owner. Site and Website Owner do not guarantee the accuracy or completeness of any of the information provided, and are not responsible for any loss resulting from your reliance on such information. The information on Site, is not legal advice and does not constitute an attorney-client relationship with all of its rights, responsibilities, and confidentiality. The purpose of information on Site is to provide advertising and give general advice for Users. No attorney-client relationship exists between any User and Really Good Wills. For an attorney-client relationship to exist, you would need to sign an engagement letter with Wightman Legal, LLC which engagement letter will detail the terms of that particular attorney-client relationship.
  5. Inappropriate Content. When accessing the Site or using reallygoodwills.com’s Services, you agree not to upload, download, display, perform, transmit or otherwise distribute any content that: (a) is libelous, defamatory, obscene, pornographic, abusive or threatening; (b) advocates or encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or foreign law or regulation; or (c) advertises or otherwise solicits funds or is a solicitation for goods or services. Reallygoodwills.com reserves the right to terminate or delete such material from its servers. Reallygoodwills.com will cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms of Use or of any applicable laws.
  6. Right to Monitor. Site and Website Owner reserve the right, butare not obligated, to monitor materials posted in any public area and shallhave the right to remove any information deemed offensive by our staff.Notwithstanding the foregoing, you remain solely responsible for your use ofany information contained on the site.
  7. Communication. Any communication made by you is not privileged or confidential. We own any and all communications made on Site, it’s servers, comments, emails, text messages. Do not send any confidential information through an email or web form as legal matters require a formal engagement letter.
  8. Discounts, Deals, and Sales. Website Owner may from time to time providediscounts, deals, and sales. These are subject to termination at any time andwill not be retroactively applied.
  9. Ownership, Copyrights, Trademarks, Licenses. Site and Website Owner own and retain all proprietary rights to the Site service, its trademarks and copyrights. Except for any information that is in the public domain, you are not authorized to reproduce, transmit or distribute the proprietary information of Site and Website Owner. By posting information to Site and Website Owner you represent that you have the right to grant permission for use by Site and Website Owner.
  10. Unsolicited Submissions. Except as may be required in connection with your use of reallygoodwills.com Services, reallygoodwills.com does not want you to submit confidential or proprietary information to us through this Site. All comments, feedback, information or material submitted to reallygoodwills.com through or in association with this Site shall be considered non-confidential. By providing such submissions to reallygoodwills.com you hereby grant reallygoodwills.com a license to use, reprint, distribute, modify and create derivative works which will be owned by reallygoodwills.com. You acknowledge that you are responsible for the submissions that you provide, including their legality, reliability, appropriateness, originality and content.
  11. No Warranties. Site and Website Owner provide the Site services on an "as is" basis and do not make any warranty, express, implied, limited or other with respect to the services provided. Specifically, Site and Website Owner do not warrant that the service will always be available, be uninterrupted, be error free, meet your requirements, or that any defects in the services will be corrected.
  12. Jurisdiction. This Agreement or any dispute arising from this Agreement is governed by the laws of Utah, without regard to provisions of conflicts of law. Any dispute arising from or related to this Agreement shall be adjudicated in the state of Utah, specifically Salt Lake County.
  13. Severability. If any provision is found to be invalid, the remaining provisions will be in full force and effect.
  14. Children. Minors are not eligible to use the Site and we ask that they do not submit any personal information to us.
  15. Entire Agreement. This Agreement constitutes your entire Agreement with Site and Website Owner with respect to any services. And no other parties have rights under this agreement aside from User and Website Owner. Website owner also reserves any rights not expressly mentioned in this Agreement.
  16. Testimonials. Any testimonials reflect an actual User’s experience with Site, but the testimonial is not a guarantee of an outcome for you as a User.
  17. Waiver. The failure of Website or Website Owner to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.  Any waiver of this Agreement by Website or Website Owner must be in writing and signed by an authorized representative of the Website Owner.
