What is a temporary guardian? And where do I name one?

A temporary guardian is an individual that you name to take care of your minor children should something happen to you that renders you incapacitated but when you are still alive. So think like a coma or a car accident or some other medical emergency. By naming a temporary guardian, you have said who you want to have legal authority over your children if you temporarily can’t care for them.

If your children have two guardians, like a mom and a dad, then this would only come into play if both guardians are rendered incapacitated.

You generally designate this in your personal power of attorney form and of course, this is included in all of our Really Good Wills packages. To take our Really Good Wills assessment and ensure that our product is the right fit for you, go here.

There is also a form called a Power of Attorney for Minor Children. This is the form that I would recommend using if you plan to go out of town and leave the children with someone watching them temporarily.
